Terms of Service

The agreement between you and AAMPLIFIED · AUDIO LAB. Please read it carefully before using the Service.

Last updated: August 21, 2026

1. Acceptance of These Terms

These Terms of Service ("Terms") are a binding agreement between you and Aamped Labs, operator of AAMPLIFIED · AUDIO LAB ("AAMPLIFIED", "we", "us"). By creating an account, uploading audio, or otherwise using the website, apps, and audio processing tools (together, the "Service"), you agree to these Terms, our Privacy Policy, and our Music Disclaimer & DMCA Policy, which are incorporated here by reference. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to use the Service, and at least 18 to purchase a subscription. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

3. Your Account

You are responsible for the accuracy of your registration information, for keeping your credentials secure, and for all activity that occurs under your account. Notify us immediately at mike@aampedlabs.com if you suspect unauthorized use. Accounts are for a single person and may not be shared or resold.

4. The Service

AAMPLIFIED provides audio processing tools that let you enhance and master audio files you supply, plus optional community, blog, and gear recommendation features. Free accounts receive a limited number of monthly boosts; Pro subscriptions unlock advanced processing tools. Features, limits, and pricing may change over time.

Processing happens in your browser and/or on our infrastructure. We do not guarantee any particular sonic result, and audio processing outcomes depend on your source material, settings, and playback system.

5. User Content and Your Sole Responsibility

"User Content" means anything you upload, create, alter, or post through the Service, including audio files, processed outputs, track titles, artwork, profile details, threads, replies, and comments.

You are solely and exclusively responsible for all User Content you upload, modify, download, store, share, or distribute through the Service. You represent and warrant that you own the necessary rights to every file you upload, or that you have obtained all licenses, permissions, and consents required from the copyright owners, publishers, performers, and any other rights holders, and that your use of the Service with that content does not infringe any third party's intellectual property, privacy, publicity, or contractual rights, and does not violate any law.

AAMPLIFIED is a neutral tool. We do not review, curate, approve, license, or clear rights for the audio you process. We do not act as your music licensing agent and provide no warranty that your intended use of any file is lawful. If you are not certain you have the rights to process a file, do not upload it.

6. Ownership and Limited License

You keep ownership of your User Content. We claim no ownership in your audio or the masters you create. You grant us a limited, worldwide, non-exclusive, royalty-free license to host, store, transmit, transcode, process, cache, and display your User Content solely to the extent necessary to operate, secure, and provide the Service to you, and to display any content you deliberately post publicly. This license ends when you delete the content, except for reasonable retention in backups and where required for legal or safety purposes.

The Service itself, including software, design, branding, presets, and text, is owned by us or our licensors and protected by intellectual property laws. You receive a personal, revocable, non-transferable license to use the Service in accordance with these Terms. You may not copy, reverse engineer, scrape, resell, or create derivative products from the Service.

7. Prohibited Conduct

  • Uploading or processing audio you do not have the legal right to use.
  • Using the Service to create, distribute, or monetize infringing or pirated recordings.
  • Impersonating another artist, label, or person, or misrepresenting authorship.
  • Uploading unlawful, defamatory, hateful, harassing, or sexually exploitative content.
  • Uploading malware, or attempting to breach, overload, probe, or disrupt the Service.
  • Circumventing usage limits, boost quotas, paywalls, or authentication.
  • Automated scraping, bulk downloading, or reselling access to the Service.
  • Abusing referral, reaction, or community features, including spam and fake engagement.

8. Copyright Enforcement and Repeat Infringers

We respond to valid copyright notices and may remove or disable access to any content we believe in good faith to be infringing, without prior notice. We maintain a repeat-infringer policy and will terminate accounts that receive multiple substantiated takedown notices. See our Music Disclaimer & DMCA Policy for the full procedure.

9. Subscriptions, Billing, and Refunds

Pro subscriptions are billed in advance on a monthly or annual basis through Stripe and renew automatically until cancelled. By subscribing, you authorize recurring charges to your payment method at the then-current price. You may cancel at any time; cancellation stops future renewals and your Pro access continues until the end of the paid period.

Except where required by law, payments are non-refundable and we do not provide partial-period refunds. We may change prices with notice; changes apply at your next renewal. Failed payments may result in suspension of Pro features.

10. Affiliate Links and Third-Party Products

The Service includes affiliate links, including Amazon Associates links, and we may earn commissions on qualifying purchases. We are not the seller of third-party gear, do not warrant it, and are not responsible for third-party pricing, availability, shipping, warranties, or support. Third-party sites are governed by their own terms and privacy policies.

11. Data Loss and Backups

You are responsible for maintaining your own copies of your audio. We may delete, limit, or lose stored files due to technical failure, storage limits, account closure, or enforcement action. Download your finished masters locally. We are not liable for lost or corrupted files.

12. Hearing, Equipment, and Safety Warning

Audio processed through the Service can be significantly louder and contain far more low-frequency energy than the source material. Excessive volume can cause permanent hearing damage, and high-output bass content can damage speakers, subwoofers, amplifiers, and vehicle components. You assume all risk. Set levels responsibly, respect your equipment's limits, and never operate playback at a volume or in a manner that impairs safe driving or violates local noise laws.

13. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and quiet enjoyment. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any processing result will meet your expectations. No advice or information obtained from us creates any warranty not expressly stated in these Terms.

14. Limitation of Liability

To the maximum extent permitted by law, AAMPLIFIED and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, audio files, or business opportunities, arising out of or relating to your use of the Service, User Content, third-party content, or equipment or hearing damage, whether based in contract, tort, strict liability, or otherwise, even if we were advised of the possibility of such damages. Our total aggregate liability for all claims relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim arose, or one hundred U.S. dollars ($100).

15. Indemnification

You agree to defend, indemnify, and hold harmless AAMPLIFIED, Aamped Labs, Car Audio Amplified, and their owners, officers, employees, and agents from and against any claims, demands, actions, damages, losses, liabilities, penalties, and expenses, including reasonable attorneys' fees, arising out of or related to: (a) User Content you upload, alter, store, share, or distribute; (b) your infringement or alleged infringement of any copyright, trademark, publicity, privacy, or other right; (c) your breach of these Terms or any law; or (d) your use or misuse of the Service, including any equipment, property, or hearing damage.

16. Suspension and Termination

We may suspend or terminate your access at any time, with or without notice, for any violation of these Terms, suspected infringement, abuse, non-payment, or risk to the Service or other users. You may stop using the Service and request account deletion at any time. Sections concerning ownership, disclaimers, limitation of liability, indemnification, and dispute resolution survive termination.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Arizona, USA, without regard to conflict-of-law rules. You and we agree that any dispute will first be raised informally by emailing mike@aampedlabs.com and that we will attempt in good faith to resolve it within 30 days. Any unresolved dispute will be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to personal jurisdiction there. To the extent permitted by law, you and we waive any right to bring or participate in a class or representative action.

18. Changes to These Terms

We may modify these Terms. We will update the "Last updated" date and, for material changes, notify you in the app or by email. Continued use after changes take effect constitutes acceptance.

19. Miscellaneous

These Terms, together with the Privacy Policy and Music Disclaimer, are the entire agreement between you and us regarding the Service. If any provision is held unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
